By accessing or using the Fungibles mobile application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. The Service is operated by Fungibles ("we," "us," or "our").

2. Description of Service

Fungibles provides a platform for sports card and collectibles enthusiasts to scan, catalog, value, and sell their collections. Our Service includes AI-powered card identification and grading analysis, real-time pricing data aggregation, collection management tools, and marketplace listing capabilities.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Subscription and Payments

4.1 Pricing

Fungibles offers subscription plans at $9.99/month for unlimited scans and full access to all features. Prices are subject to change with notice.

4.2 Billing

Subscriptions are billed in advance on a monthly basis. You authorize us to charge your payment method on file for all applicable fees.

4.3 Cancellation

You may cancel your subscription at any time through your account settings or the app store where you subscribed. Cancellation will take effect at the end of your current billing period.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service or servers
• Upload malicious code or content
• Scrape, data mine, or harvest data from the Service
• Impersonate any person or entity
• Use the Service to commit fraud or misrepresent card conditions

6. AI Grading and Pricing Disclaimer

The AI grading analysis and pricing information provided by Fungibles are for informational purposes only. Our AI predictions are estimates based on image analysis and historical data. They are not professional grading opinions and should not be relied upon as such. Actual grades from PSA, BGS, SGC, or other grading companies may differ. Pricing data is aggregated from third-party sources and may not reflect current market conditions. We do not guarantee the accuracy of any pricing information. You are solely responsible for your buying and selling decisions.

7. Marketplace and Third-Party Services

When you list cards for sale through our Service, you may be directed to third-party marketplaces (eBay, Whatnot, COMC, etc.). Your use of these platforms is subject to their respective terms of service. We are not responsible for transactions conducted on third-party platforms. We do not guarantee the completion of any sale.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Fungibles and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you submit, but grant us a license to use, display, and distribute it in connection with the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNGIBLES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Fungibles, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
